ニューヨークタイムズで、現在、ニューヨーク市の地下鉄やバスでの運賃逃れが再び増加というニュースを知った。具体的には、ニューヨーク市内のバス乗車の約半分で運賃が支払われてなく、これが公共交通システムにとって深刻な財政問題となっているらしい。

今回のニューヨークのニュースもそうだけれど、以前から話題になっているカリフォルニア州といい、大都市での治安や刑事司法の問題は複雑そうだ。

ニューヨークで運賃逃れが増加している理由の１つとして、軽微な犯罪に対して厳しい処罰を行うことが、必ずしも社会の安全や公正に貢献しないという認識が広まったからだという。特に、運賃逃れの取り締まりが不当に貧困層やマイノリティに集中しているとの批判から、マンハッタンは2017年以降、運賃逃れに対する訴追がほとんど行わなくなったらしい。

一方、サンフランシスコのテンダーロイン地区では、「Proposition 47」というカリフォルニア州の法律が2014年に可決、950ドル以下の窃盗が重罪ではなく軽罪とされた。これは刑務所の過密化を解消し、刑事司法制度の公平性を向上させるために導入されたというけれど、こちらも背景には、軽犯罪に対する厳しい処罰が特に貧困層やマイノリティに不均衡に適用されているという批判があったということ。

I recently came across a New York Times article reporting that fare evasion in New York City’s subways and buses is on the rise again. Specifically, about half of all bus rides in the city are now unpaid, creating a significant financial problem for the public transportation system.

This issue in New York, like the ongoing situation in California, seems quite challenging.

One reason for the increase in fare evasion in New York is the growing recognition that harsh punishments for minor offenses do not necessarily contribute to public safety or justice. In particular, criticism has mounted over the fact that fare evasion crackdowns disproportionately target low-income communities and minorities. As a result, since 2017, Manhattan has significantly reduced prosecutions for fare evasion.

Meanwhile, in San Francisco’s Tenderloin district, California’s “Proposition 47,” which was passed in 2014, reclassified thefts of less than $950 from a felony to a misdemeanor. This law was introduced to alleviate prison overcrowding and promote fairness in the criminal justice system. However, this reform also stems from criticism that harsh punishments for minor crimes were disproportionately applied to low-income and minority groups.

The debate over whether harsh penalties for minor crimes are fair or whether the relaxation of enforcement undermines public safety is ongoing. Both perspectives have valid points, making it clear that finding the right balance is no easy task.

Even seemingly small issues like fare evasion or minor crime enforcement reveal larger themes about the structure and direction of society as a whole.
